If a baby’s born born preterm & underweight, can the mom take the baby home even if the hospital wants it to stay?

Say someone that recently gave birth Moderate preterm at 33 weeks (I think she was due at 38) and the baby is abt 3 lbs 3 ozs. It’s been a couple days and she’s cleared to go home, but hospital wants baby to stay in NICU until she gains more weight. The baby’s not having any problems, just underweight. Mom says she’s not leaving without her baby and she’s ready to leave because she wants to go home since she doesn’t like being in hospitals. Can she leave with the baby against the doctor’s advice ? Can the hospital force the baby to stay even if it’s just because it’s underweight?
