My parent has to have surgery on short notice. They set up mychart and told her to use it for E-Check in. The E-Check In doesn't address pre-surgery instructions, or anything. It's just a bunch of legalese that appears to waive her medicare protections. Her MyChart has no care team assigned as the doctors are external to the institution so messaging is turned off.
We live in Texas so we have new laws on surprise billing as well that this check-in appears to be waiving her protections there as well (IANAL).
I know MyChart records are legal documents. Is MyChart being used to trick people into waiving medicare billing protections? Basically agreeing to pay more than medicare covers. Do you have to use E-Check In? Can you just check in the day of and refuse to sign those portions of any paperwork.
This hospital system tried to trick a friend into waiving their right to medicaid protections and pay more than what medicaid would pay and kept asking them to agree and speak clearly as they were being recorded.
How do you protect your loved one, in this situation?
