Is the MSE requirement of EMTALA generally considered fulfilled if the only step taken by the ED physician is to order standard lab tests (CBC and basic metabolic panel) along with review of existing records? Assuming a conscious patient, is a physician (or mid-level if the hospital policy authorizes them to perform MSEs) required to ask about symptoms, conduct a physical exam (e.g. palpation of an area for pain, assess limb movement, that sort of thing), or is ordering and reviewing labs considered enough?
